Welcome to TerakoyaCloud Practice Log (“TCPL”, “TerakoyaCloud”, “we”, “our”, or “the Service”).
By accessing or using TCPL, you agree to these Terms of Service (“Terms”).
If you do not agree to these Terms, please do not use the Service.
1. Nature of the Service
TCPL is currently provided as a prototype / MVP (Minimum Viable Product).
The Service may change, evolve, or discontinue at any time.
Features may be added, removed, suspended, or modified without prior notice.
We do not guarantee:
- uninterrupted availability;
- permanent preservation of data;
- error-free operation;
- continued availability of any specific feature;
- compatibility with all devices, browsers, or third-party services.
You acknowledge that you are using a developing platform.
2. Purpose of TCPL
TCPL is a practice-sharing and learning-support platform designed to help users:
- log musical practice;
- share practice goals and progress;
- reflect on practice sessions;
- request and provide feedback;
- organize practice around events or future goals;
- share knowledge, annotations, questions, and answers;
- build a supportive learning community.
TCPL is not a competitive ranking platform.
It is not designed to promote harassment, shaming, comparison-based pressure, or public evaluation based on popularity.
3. User Accounts
To use certain features, you must create an account.
You agree to:
- provide accurate information;
- keep your login credentials secure;
- be responsible for all activity under your account;
- notify us if you believe your account has been accessed without authorization.
We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or undermine the purpose of the Service.
4. Minors and Parental Consent
TCPL may be used by learners of different ages, including children and young students.
If you are under the age required by applicable law to consent to the use of online services, you may use TCPL only with the consent and supervision of a parent or legal guardian.
Parents or legal guardians are responsible for supervising the use of TCPL by minors under their care.
Users should not post sensitive personal information about children, including full names, addresses, school details, or other information that may identify or expose a minor to risk.
5. Content Ownership
You retain ownership of content that you create or submit to TCPL, including:
- practice logs;
- written notes;
- uploaded images, videos, or other media;
- feedback comments;
- event information;
- event reflections;
- knowledge suggestions;
- annotations;
- questions and answers;
- profile information;
- other user-generated content.
You are solely responsible for the content you post, upload, submit, or share through the Service.
6. License to TCPL
By posting, uploading, submitting, or sharing content on TCPL, you grant TCPL a non-exclusive, worldwide, royalty-free license to store, display, reproduce, distribute, format, adapt for display, and make available that content within the Service according to your selected visibility settings and the functionality of the Service.
This license allows TCPL to:
- display your content within the platform;
- make your content available to users who have permission to view it;
- operate invitation, feedback, event, knowledge, annotation, and search-related features;
- preserve anonymized content after account deletion, as described in these Terms;
- use sample, anonymized, or non-identifying content for service improvement, demonstration, or explanatory purposes, where appropriate.
This license does not transfer ownership of your content to TCPL.
7. User Responsibility for Content
You represent and warrant that:
- you have the right to post, upload, link, or share the content;
- your content does not infringe copyright, trademark, privacy, publicity, or other rights of third parties;
- your content complies with applicable laws;
- your content does not contain unlawful, defamatory, abusive, discriminatory, harassing, or harmful material.
You are responsible for ensuring that any music, performance, recording, score, sheet music, lyrics, backing track, image, video, or other copyrighted material you post or link to is used lawfully.
TCPL is not responsible for verifying the legality, accuracy, or ownership status of user-submitted content.
8. Media and External Links
TCPL may allow users to submit, upload, embed, or link to media, including but not limited to:
- YouTube links;
- Instagram links;
- TikTok links;
- other third-party media links;
- uploaded images;
- uploaded videos;
- external websites;
- embedded content.
Third-party services are governed by their own terms, policies, and technical limitations.
TCPL is not responsible for:
- the availability of third-party services;
- changes to third-party embed behavior;
- deleted or unavailable external content;
- third-party copyright claims;
- third-party tracking, advertising, or data practices.
Users should exercise caution when clicking external links or sharing external media.
9. Visibility Settings
TCPL may provide visibility settings such as:
- Public;
- Members only;
- Private;
- Invitation-based access;
- Event-related visibility;
- other access-control options.
While TCPL implements reasonable access controls, we cannot guarantee absolute privacy, security, or confidentiality.
Users should avoid sharing sensitive personal information, private recordings, private locations, or other material that they would not want others to access.
Some features may display summaries, references, titles, metadata, or relationships between content even when the full content is restricted.
10. Practice Logs and Performance Logs
TCPL allows users to create practice logs and performance logs.
Practice logs are intended for recording practice activities, goals, focus areas, reflections, media, and progress.
Performance logs may be used to share performances, recordings, or outcomes, and may be associated with events or other contexts.
Users are responsible for the accuracy, appropriateness, and legality of the content included in their logs.
TCPL does not guarantee that posting practice logs or performance logs will result in skill improvement, feedback, recognition, or any particular educational outcome.
11. Practice Session Data, Drafts, and Auto-Save
TCPL may provide features such as:
- practice session start and finish times;
- practice duration;
- draft saving;
- auto-save;
- continued drafts;
- editing of practice logs.
These features are provided for convenience and reflection.
TCPL does not guarantee that:
- drafts will always be saved;
- auto-saved content will always be restored;
- practice duration will always be accurate;
- session data will be preserved permanently;
- edited content will always update all related summaries immediately.
Users are encouraged to keep independent copies of important content.
12. Practice Analytics and Progress Indicators
TCPL may provide analytics, summaries, or visual indicators, including but not limited to:
- Focus Progress;
- practice rhythm;
- practice calendars;
- practice duration summaries;
- recent activity;
- progress trends;
- focus ratings;
- delta-based progress indicators;
- dashboard cards;
- event-related summaries.
These features are provided for reflection and convenience only.
They may be incomplete, inaccurate, delayed, affected by caching, affected by user input, or changed as the Service evolves.
TCPL does not guarantee the accuracy, completeness, educational validity, or continued availability of any analytics or progress indicators.
13. Invitation and Feedback System
TCPL may allow users to request or provide feedback through features such as:
- Direct Invitations;
- Open Invitations;
- feedback requests;
- invited access;
- applications to give feedback;
- related notifications.
By inviting others, applying to give feedback, or providing feedback, you agree to communicate respectfully and constructively.
Feedback must not contain:
- harassment;
- abuse;
- threats;
- discrimination;
- personal attacks;
- shaming;
- unwanted solicitation;
- inappropriate comments about a person’s appearance, identity, background, or private life.
TCPL may remove feedback, restrict invitation features, revoke access, or suspend accounts if feedback or invitation behavior violates these Terms or the purpose of the Service.
14. Events
TCPL may allow users to create, join, leave, relate content to, or reflect on events.
Events may be used for:
- personal practice goals;
- future performance targets;
- community activities;
- online or offline gatherings;
- practice periods;
- self-organized projects;
- other musical or learning-related purposes.
TCPL is not the organizer, host, manager, agent, sponsor, or supervisor of user-created events unless explicitly stated otherwise.
Users who create or participate in events are responsible for:
- the accuracy of event information;
- communication with participants;
- safety and appropriateness of any offline activity;
- compliance with applicable laws;
- respecting other users’ privacy and boundaries;
- managing participation expectations.
TCPL is not responsible for disputes, cancellations, injuries, losses, misunderstandings, or other issues arising from user-created events or interactions connected to events.
15. Event Participation and Reflections
TCPL may allow users to:
- join events;
- leave events;
- create sub-events;
- associate practice logs or performance logs with events;
- write event reflections;
- view event-related activity.
Event-related content may be displayed according to the visibility settings of the event and the related content.
A public event does not necessarily make all related logs public.
A private log does not necessarily become public simply because it is related to an event.
Users should review visibility settings carefully before posting event-related content.
16. Knowledge, Annotations, Questions, and Answers
TCPL may allow users to create, suggest, annotate, ask about, answer, or relate knowledge content.
This may include:
- Knowledge articles;
- Knowledge suggestions;
- Annotations;
- Questions;
- Answers;
- Related Focuses;
- Related Contexts;
- educational explanations;
- practice tips;
- theory-related content;
- user interpretations and comments.
Such content reflects the views, interpretations, experiences, or opinions of individual users.
Knowledge content on TCPL does not constitute:
- official instruction;
- professional certification;
- medical advice;
- legal advice;
- psychological advice;
- guaranteed educational guidance;
- a substitute for a qualified teacher, professional, or specialist.
Users should use their own judgment when relying on knowledge content shared by others.
17. Moderation and Review
TCPL may review, approve, reject, hide, edit, reclassify, restrict, or remove user-submitted content, including but not limited to:
- practice logs;
- performance logs;
- feedback;
- event content;
- event reflections;
- knowledge suggestions;
- annotations;
- questions;
- answers;
- comments;
- profile content;
- uploaded media;
- external links.
TCPL may also assign or change user roles, trusted status, moderation permissions, or feature access.
Moderation may be performed by administrators, trusted users, automated systems, or a combination of these.
TCPL is not obligated to review all content before publication and does not guarantee that inappropriate content will be detected immediately.
18. Demo Users and Sample Content
TCPL may provide demo users, sample practice logs, sample events, sample feedback, sample knowledge content, or other simulated content for purposes such as:
- demonstration;
- testing;
- onboarding;
- education;
- promotion;
- feature explanation.
Demo content may be fictional, partially fictional, generated, edited, or created for illustrative purposes.
Demo users, demo logs, demo events, and demo interactions may not represent real users, real performances, real practice histories, or real events.
Some demo features may be read-only or restricted to prevent changes to sample data.
19. Community Conduct
TCPL is intended to be a respectful learning environment.
You agree not to:
- harass, threaten, or intimidate other users;
- shame or ridicule other users’ skill level, practice process, appearance, age, background, or identity;
- post defamatory, illegal, hateful, discriminatory, or abusive material;
- post sexually explicit, violent, or otherwise inappropriate content;
- impersonate another person;
- access or attempt to access private content without permission;
- interfere with the operation or security of the Service;
- upload malware, spam, or harmful code;
- scrape, copy, or harvest user data without permission;
- use the Service for unauthorized advertising or solicitation;
- misuse invitation, feedback, event, annotation, or messaging-related features.
Behavior that undermines the purpose of TCPL may result in content removal, feature restriction, account suspension, or account termination.
20. No Professional or Educational Guarantee
TCPL does not guarantee:
- musical improvement;
- technical improvement;
- successful practice outcomes;
- feedback from other users;
- professional results;
- admission to schools or programs;
- certification;
- public recognition;
- performance opportunities;
- income or career benefit.
All feedback, analytics, knowledge content, and community interactions are informal unless explicitly stated otherwise.
Users remain responsible for their own learning, practice decisions, and use of information obtained through the Service.
21. Privacy and Personal Information
TCPL may collect and process information necessary to provide the Service, such as account information, profile information, content, usage-related data, language settings, and communication-related data.
Our handling of personal information may be described in a separate Privacy Policy.
If a separate Privacy Policy is provided, it forms part of the overall agreement between you and TCPL.
Users should not post sensitive personal information about themselves or others unless they fully understand the risks of doing so.
22. Data and Availability
As a prototype service:
- data loss may occur;
- backups are not guaranteed;
- features may break or change;
- content may become temporarily or permanently unavailable;
- the Service may experience downtime;
- third-party integrations may stop working;
- migrations or updates may affect content display.
You are encouraged to keep independent copies of important logs, media, notes, feedback, event information, and knowledge content.
23. Account Deletion and Anonymization
Users may request deletion of their account through the Service settings or by contacting TCPL.
Upon account deletion, TCPL may delete or anonymize:
- the user account;
- email address;
- login credentials;
- profile image;
- profile information;
- personal metadata directly identifying the user.
However, certain contributions may remain on the platform in anonymized or non-identifying form, including but not limited to:
- practice logs;
- performance logs;
- feedback comments;
- event participation history;
- event reflections;
- knowledge suggestions;
- annotations;
- questions;
- answers;
- other community contributions.
The display name may be replaced with a neutral identifier such as “Former Member”.
By using TCPL, you acknowledge and agree that anonymized contributions may remain as part of the community archive, consistent with the license granted in these Terms.
Where required by applicable law, users may request further data removal, subject to technical feasibility, legal obligations, backup limitations, and the rights or legitimate interests of other users.
24. Content Removal Requests
If you believe that content on TCPL infringes your rights, violates these Terms, or exposes sensitive information, you may contact TCPL and request review or removal.
TCPL may request additional information to evaluate the request.
TCPL may remove, restrict, anonymize, or decline to remove content at its discretion, subject to applicable law.
25. Intellectual Property of TCPL
The Service itself, including its design, structure, software, code, interface, logos, trademarks, visual elements, and original platform content, is owned by or licensed to TCPL, except for user-generated content.
You may not copy, modify, distribute, reverse engineer, or create derivative services based on TCPL without permission, except as allowed by applicable law.
26. Changes to the Service
TCPL may update, modify, suspend, or discontinue any part of the Service at any time.
This includes changes to:
- practice log features;
- event features;
- knowledge features;
- invitation and feedback features;
- visibility settings;
- analytics;
- moderation systems;
- demo content;
- account features;
- design and user interface;
- available languages.
TCPL is not liable for any loss or inconvenience caused by changes to the Service.
27. Termination by TCPL
We may suspend, restrict, or terminate your access to TCPL if:
- you violate these Terms;
- you misuse the Service;
- your conduct harms other users or the community;
- legal compliance requires action;
- security concerns arise;
- the platform is discontinued;
- continued access is otherwise deemed inappropriate by TCPL.
Termination may result in loss of access to your account and content.
Certain content may remain anonymized as described in these Terms.
28. Disclaimer of Warranties
To the fullest extent permitted by law, TCPL is provided “as is” and “as available”.
We make no warranties, express or implied, regarding:
- availability;
- reliability;
- accuracy;
- fitness for a particular purpose;
- educational effectiveness;
- data preservation;
- security;
- error-free operation;
- compatibility with third-party services.
Your use of TCPL is at your own risk.
29. Limitation of Liability
To the fullest extent permitted by law, TCPL and its operator shall not be liable for:
- loss of data;
- loss of content;
- loss of opportunity;
- reputational harm;
- emotional distress;
- indirect damages;
- incidental damages;
- consequential damages;
- disputes between users;
- issues arising from events;
- third-party service failures;
- unauthorized access despite reasonable precautions;
- reliance on feedback, analytics, knowledge content, or user-generated information.
Users assume responsibility for their own use of the platform and interactions with others.
30. Indemnification
You agree to indemnify and hold harmless TCPL and its operator from claims, damages, liabilities, losses, and expenses arising from:
- your use of the Service;
- your content;
- your violation of these Terms;
- your violation of applicable law;
- your infringement of third-party rights;
- disputes arising from events or interactions with other users.
31. Changes to These Terms
These Terms may be updated as TCPL evolves.
When we make changes, we may update the “Last updated” date.
Continued use of the Service after the updated Terms become available constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you should stop using the Service.
32. Language
These Terms may be translated into other languages.
Unless otherwise required by applicable law, if there is any inconsistency between translations, the English version shall prevail.
33. Governing Law
These Terms shall be governed by the laws of Japan, unless otherwise required by applicable international regulations.
